Introduction
The so-called "Terms of Sale" of this Contract indicate, in clear and easily understandable language, the terms and conditions applicable to the purchase of consumer goods through the website https://anididesign.it/.
You are required to carefully read the Terms of Sale before placing an online order.
By placing an order through the website, you confirm that you have read and accepted the Terms of Sale, by ticking the relevant box.
These Terms of Sale, together with the order confirmation, represent the contract for the supply of consumer goods between you and the Seller, as identified above. No other conditions or terms may apply.
The Seller may amend these Conditions at any time. You must only accept the Terms of Sale in force at the time of your purchase, a copy of which will be sent to you and/or made accessible to the email address you provided by filling in the relevant form or during the registration process on the website https://anididesign.it/
The current Terms of Sale are also published on the website https://anididesign.it/ so that you can read them, save them to your devices and/or reproduce them. These premises form an integral and essential part of the online Sales Contract between you and the Seller.
1. Subject of the contract
1.1. With this contract, respectively, the Seller sells and you purchase remotely, through electronic means, the products indicated and offered for sale on the website https://anididesign.it/, which you have added to your cart.
2. Purchases by registered or unregistered users
2.1. You can make a purchase whether you are a registered user, by accessing your personal area, or if you are not registered, by filling in all the fields (name, surname, shipping address, telephone number, email address and other data eventually necessary for invoicing) that will be requested on screen, and you will have to repeat them every time you make a purchase.
3. Method of concluding the contract
3.1. The contract between you and the Seller is concluded exclusively through the Internet by your access to the address https://anididesign.it/
3.2. You can purchase goods by completing the order process. To complete the order you must:
- add the desired products to your cart in the quantity you wish to receive,
- enter the requested data on the screen, and
- select the payment method;
you will complete your purchase, and you will no longer be able to modify it, by clicking on the "PAY NOW" button, which unequivocally indicates that placing the order implies the obligation to pay the Seller.
3.3. Before submitting the order, you can identify and correct any data entry errors by following the instructions on the Site or modify the order;
after the order has been submitted, however, the order cannot be modified; without prejudice, in any case, to the right of withdrawal referred to in the following point "Right of withdrawal".
3.4. Once the purchase is complete, you will receive a copy of the order via email (order summary email) - with a link to download these conditions in PDF format - whether you are a registered user or if you have decided not to proceed with registration.
If you are a registered user, you will also find a summary of your orders in your personal area.
3.5. The order number, generated by the system and communicated by the Seller regarding the purchase made in the order summary email indicated above, must be used in all subsequent communications with the Seller.
3.6. The Seller reserves the right not to accept orders, from anyone, that appear abnormal in relation to the quantity of products purchased or the frequency of purchases made on the Site, as well as in relation to the improper or suspicious use of any gift vouchers, discounts or freebies.
The Seller will notify you of any inability to accept received orders within 24 (twenty-four) hours from the working day following the day you placed the order and will refund any amounts already paid for the payment.
4. Payment methods
4.1. Payments can only be made by one of the methods indicated in the purchase form.
4.2. In case of payment by bank transfer, credit card or PayPal, the Seller will proceed with the shipment only after receiving payment confirmation.
5. Shipping costs
5.1. Shipments will be made to Italy and Europe (Austria, Belgium, Bulgaria, Croatia, Denmark, Estonia, Finland, France, Germany, Great Britain, Greece, Ireland, Latvia, Lithuania, Luxembourg, Norway, Netherlands, Poland, Portugal, Principality of Monaco, Czech Republic, Slovakia, Romania, Slovenia, Spain, Sweden, Switzerland, Hungary) via courier. Standard shipping costs are:
• €6.90 for orders up to €199.99 for Italy
• €7.90 for orders up to €199.99 for islands (Sicily, Sardinia) and Calabria
• Free for orders equal to or above €200.00
• €11.00 for orders up to €199.99 for Europe (Austria, Belgium, Bulgaria, Croatia, Denmark, Estonia,
Finland, France, Germany, Great Britain, Greece, Ireland, Latvia, Lithuania, Luxembourg, Norway, Netherlands, Poland, Portugal, Principality of Monaco, Czech Republic, Slovakia, Romania, Slovenia, Spain, Sweden, Switzerland, Hungary)
5.2. You may choose to use shipping options other than the standard ones, by sending a written request to the email address letiziamoretti@icloud.com.
5.3. The products will be shipped within the timeframe indicated in the following paragraph "Delivery times and methods"
6. Delivery times and methods
6.1. The Seller will deliver the selected and ordered product(s) using the method you have chosen, as confirmed in the order summary email.
6.2. Standard shipping delivery will be made via Express Courier, shipment will take place within 1 to 4 working days from receipt of payment, delivery time is 24/48 hours but for some remote locations and smaller islands it may be longer.
6.3. Delivery times and methods other than the standard will be indicated on screen.
6.4. Delivery will in any case take place within a maximum of 30 days from receipt of payment (or from order confirmation in the case of cash on delivery payments).
6.5. Should the Seller be unable to meet the above deadlines, or should delivery be delayed or excessively burdensome due to a reason attributable to you, you will in any case be promptly notified, so that you can grant the Seller an additional deadline, after which the contract will be terminated and you will receive a refund of what you have paid.
6.6. Delivery will take place without an appointment. In case of cash on delivery, there will only be one delivery attempt.
6.7. In other cases, the courier will leave a notice with instructions for further delivery attempts or for collecting the goods held in storage at the courier's warehouse.
6.8. If you do not collect the products within the time indicated by the courier, the order will be automatically cancelled and the products will be returned to the Seller, and you will be charged the related costs.
6.9. Upon delivery of the goods, whether you receive the goods directly or through a third party designated by you, you will physically take possession of the products and the risk of loss or damage to the goods due to causes not attributable to the Seller will be transferred to you.
6.10. Upon delivery of the products, you are required to check that the packaging is intact, not damaged, not wet or crushed or otherwise altered, including in the sealing materials. If there is obvious damage to the packaging and/or the product, you may refuse delivery of the products, which will be returned to the Seller at no cost to you; alternatively, you must indicate "accepted with reservation" on the delivery note.
Once the delivery document has been signed without reservation, you will not be able to raise any objection regarding the external characteristics of the delivered packages.
6.11. If you decide to use the "collect from the company" option, you can collect directly from the Seller's address at Via Giuseppe di Vittorio 2/B (06012) Città di Castello (PG). If you do not collect within 15 days of purchase, your order will be canceled and any price paid will be refunded to you.
7. Product and price information
7.1. Each product is accompanied by an information sheet illustrating its main features (the so-called "Product Sheet").
7.2. The visual representation of the products on the Site, where available, normally corresponds to the digital photographic image accompanying the descriptive sheet. The image is solely for the purpose of presenting the products for sale and to this end is representative of their characteristics.
7.3. All sales prices of the products displayed and indicated on the website https://anididesign.it/, are expressed in euros and constitute a public offer pursuant to art. 1336 of the Italian Civil Code.
7.4. The sales prices, as referred to in the previous point, include VAT and any other taxes.
7.5. Shipping costs, if any, although not included in the purchase price, are indicated and calculated during the purchase process before you submit your order and are also contained on the order summary web page.
8. Product Availability
8.1. The system used on our site only allows you to purchase products that are in stock.
8.2. Products not in stock are not indicated as available, and in any case, even if the page offering them has not yet been updated, they will be removed from the cart.
8.3. Quantities exceeding the available portion of products will also be automatically removed from the cart.
8.4. Regardless of product availability, you cannot order more than 50 items in a single cart.
8.5. However, product availability refers to actual availability at the time you place the order. This availability must in any case be considered purely indicative as:
a) products may be sold to others before order confirmation, due to the simultaneous presence of multiple users on the Site;
b) an IT anomaly may occur making a product available for purchase that is not actually available.
In case of unavailability, the Seller will immediately notify you by email and the contract will be immediately terminated, limited to the unavailable product(s) (or product(s) that have become unavailable).
8.6. In the event that the purchase contract for the product(s) is terminated due to unavailability of the product(s), limited to such product(s), the amount due in relation to such product(s), including delivery costs, and any other additional costs specifically due in relation to such product(s), will be refunded within 14 (fourteen) working days, if already paid.
8.7. The refund amount will be communicated to you by e-mail.
9. Legal Guarantee of Conformity and Assistance Procedures
As a consumer, you are entitled to a guarantee for defects of conformity.
a. What is a defect of conformity
9.1. A defect of conformity exists when the purchased product:
a) is not fit for the purposes for which goods of the same type are normally used;
b) does not conform to the description given by the Seller and does not possess the qualities of the goods that the Seller presented to the buyer as a sample or model;
c) does not show the usual quality and performance of goods of the same type, which the buyer can reasonably expect, also taking into account statements made in advertising, labeling or the product sheet;
d) is not fit for the particular purpose desired by the buyer and that was made known to the Seller by the buyer at the time of the conclusion of the contract.
9.2. Therefore, any subsequent defects or flaws caused by accidental events or the Buyer's responsibility, or by incorrect storage, use of the product not in accordance with its intended use and/or what is indicated in the "Product Sheet," are excluded from the scope of the Legal Guarantee. Furthermore, any changes in the organoleptic characteristics of the products that may occur without altering their functionality are not covered by the conformity guarantee, in particular, changes described in the "Product Sheet" are not covered.
b. When it applies
9.3. The Seller is liable to you for any lack of conformity existing at the time of delivery of the product that becomes apparent within two years of such delivery.
9.4. The lack of conformity must be reported to the Seller, under penalty of forfeiture of the warranty, within 2 (two) months from the date on which it was discovered.
9.5. Notification is not necessary if the Seller has acknowledged the existence of the defect or has concealed it.
9.6. Unless proven otherwise, it is presumed that conformity defects that become apparent within 6 (six) months from the delivery of the product already existed at that date, unless this hypothesis is incompatible with the nature of the product or with the nature of the conformity defect.
9.7. In order to benefit from the Legal Guarantee, you must therefore first provide proof of purchase and delivery of the product.
c. Remedies available to you
9.8. In case of a defect of conformity duly reported within the terms, you will have the right, primarily, to the free repair or replacement of the product, unless the requested remedy is objectively impossible or excessively burdensome compared to the other.
9.9. The request must be submitted in writing, by registered letter with return receipt or certified e-mail, to the Seller, who will indicate their willingness to comply with the request, or the reasons that prevent them from doing so, within 7 (seven) working days of receipt. In the same communication, if the Seller has accepted your request, they must indicate the methods of shipment or return of the product as well as the expected timeframe for the return or replacement of the defective product.
9.10. Alternatively, if repair and replacement are impossible or excessively burdensome (pursuant to Article 130, paragraph 4, of the Consumer Code), or if the Seller has not repaired or replaced the product within the period specified in the preceding point, you may request a price reduction or termination of the contract. You may also request a price reduction or termination of the contract if the replacement or repair previously carried out has caused you significant inconvenience.
9.11. If the Seller has accepted your request, the Seller must indicate the proposed price reduction or the methods for returning the defective product. You will need to indicate the methods for re-crediting the sums previously paid to the Seller.
9.12. The requested remedy is excessively burdensome if it imposes unreasonable expenses on the Seller compared to alternative remedies that can be pursued, taking into account (i) the value the product would have if there were no lack of conformity; (ii) the extent of the lack of conformity; (iii) the possibility that the alternative remedy can be pursued without significant inconvenience to the buyer.
d. What to do in the presence of a lack of conformity
9.13. If a product purchased on the website https://anididesign.it/, during the validity period of the Legal Guarantee, shows what could be a lack of conformity, you can contact Customer Service at the addresses indicated in point 13 below.
9.14. The Seller will promptly respond to the communication of the alleged lack of conformity and will indicate the specific procedure to follow, also taking into account the product category to which the product belongs and/or the reported defect.
10. Buyer's Obligations
10.1. You undertake to pay the price of the purchased product within the times and methods indicated in the contract.
10.2. You undertake, once the online purchase procedure is completed, to print and keep this contract if you have received a copy, also via a link.
10.3. The information contained in this contract is considered to have been read and accepted by you, and you will acknowledge this before confirming the purchase. You will be obliged to accept these terms and conditions of sale to proceed with the purchase and you will be provided with a link to these conditions, which you undertake to read.
11. Right of withdrawal
11.1. As a Consumer, you have the right to withdraw from the product purchase contract without giving any reason and without incurring costs other than those provided for in point 13 below, within 14 (fourteen) calendar days.
Therefore, you must send the communication regarding the exercise of the right of withdrawal before the expiry of the 14 calendar days, which are calculated from the moment the order is delivered to you, and in particular:
a) in the case of an order relating to a single product, the day on which you or a third party, other than the carrier and designated by you, acquire physical possession of the product;
b) in the case of a Multiple Order with separate deliveries, the day on which you or a third party, other than the carrier and designated by you, acquire physical possession of the last product;
c) in the case of an order relating to the delivery of a product consisting of multiple lots or pieces, the day on which the buyer or a third party, other than the carrier and designated by you, acquire physical possession of the last lot or piece.
11.2. To exercise the right of withdrawal, you must therefore inform the Seller, within 14 (fourteen) calendar days, of your decision to withdraw. To this end, you can:
a) use the standard withdrawal declaration made available to you through the Website ("Withdrawal Declaration") and reproduced at the bottom of these conditions; or
b) submit any other explicit declaration of your decision to withdraw from the contract by following the "Instructions on Withdrawal", available in the footer of the Website.
11.3. Should you wish to use the "Withdrawal Declaration" prepared on the site, you must indicate the order number, the product(s) for which you intend to exercise the right of withdrawal and your address. Since the burden of proof relating to the exercise of the right of withdrawal before the expiry of the withdrawal period lies with you, it is in your interest to use a durable medium when communicating your withdrawal to the Seller.

11.5. Upon receipt of the communication in which the Buyer communicates the exercise of the right of withdrawal, the parties to this contract are released from their mutual obligations.
12. Exclusion of the right of withdrawal
12.1. The Right of Withdrawal is excluded in the cases referred to in Article 59 of the Consumer Code and specifically in those relating to:
- the supply of goods made to measure or clearly personalised;
- the supply of goods that are liable to deteriorate or expire rapidly;
- the supply of sealed products that are not suitable for return for hygienic reasons or related to health protection and have been opened after delivery (cosmetic products);
13. Return of the goods and timing and methods of refund
13.1. If you intend to exercise the right of withdrawal, you must also return the product to the Seller, using a carrier of your choice and at your expense, without undue delay and in any case within 14 (fourteen) calendar days from the date on which you communicated your decision to withdraw to the Seller. The deadline is met if you send back the product before the expiry of the 14 (fourteen) day period.

The direct costs of returning the product(s) to the Seller are at your expense.
13.3. If you withdraw from the contract, the Seller will refund the total amount due paid by you for the product, including standard delivery costs, without undue delay and in any case no later than 14 (fourteen) calendar days from the day on which the Seller was informed of your decision to withdraw from the contract. However, the Seller may withhold the refund until he has received the goods or until you have demonstrated that you have returned them, whichever occurs first.
13.4. The refund will be made using the same payment method you used for the initial transaction, unless you have expressly agreed otherwise. In any case, you will not incur any additional costs.
13.5. You are responsible for any decrease in the value of the product resulting from handling other than what is necessary to establish its nature, characteristics and functioning. The product must in any case be kept, handled and inspected with normal diligence and returned intact, complete in all its parts, perfectly functioning, accompanied by all accessories and instruction leaflets, with the labels, where present, still attached to the product, as well as perfectly suitable for the use for which it is intended.

15. Contract storage methods
15.1. Pursuant to Article 12 of Legislative Decree 70/2003, the Seller informs you that every order sent is stored digitally on the server used by the Seller; you can find further information on the hosting service in the information on the processing of personal data published on the website https://anididesign.it/
16. Language, applicable law and competent court
16.1. This contract concluded through the Website is drawn up in Italian and governed by Italian law.
16.2. For any dispute concerning the interpretation, validity or execution of this contract, the competent court is that of the place of residence or elective domicile of the buyer. This court is mandatory pursuant to Article 33, paragraph 2, letter u) of the Consumer Code.
17. Amendments and updates
17.1. These General Terms and Conditions of Sale are amended from time to time by the Seller, also in consideration of any regulatory changes. The new General Terms and Conditions of Sale will be effective from the date of publication on the Website.
